David Cantor explains how you can still drive after a DUI arrest:
If you have been arrested for DUI in the state of Arizona, it doesn’t mean you will immediately lose your driving privileges. In some cases, a law enforcement officer may take away your driver’s license and hand you a pink and a yellow piece of paper that is called an Implied Consent / Administrative Per Se Affidavit. Once you receive this document you will need to request a hearing within 15 days. If you do not request the hearing within 15 days it will result in your license being suspended for 90 days to 1 year.
When you meet with your DUI Defense lawyer, you will need to bring this document and have the attorney request a hearing via the pink piece of paper. Once the request for a hearing has been made, you will return and carry the yellow copy of the same Implied Consent / Administrative Per Se Affidavit. This yellow copy of the form is essentially a temporary driving permit, and this will allow you to continue driving. This form serves as your driver’s license until you have a DMV hearing, which may take place in two to three months.
If a law enforcement officer suspects you of driving under the influence, your driver’s license will be suspended if you show a BAC of .08 or more, or if you refuse to take a blood alcohol test. When pulled over, you will be given a choice of taking a blood test or breathalyzer test. If you choose a blood test, the results will not be instant, which means that you may not receive the Implied Consent / Administrative Per Se Affidavit right away. This form will be mailed to you if your blood test results show a blood alcohol level of .08 or higher. In some cases, you will not get your temporary driver’s permit by mail. Even in this case, you are still able to drive legally until you have a DMV hearing.
