Five Things To Know About Arizona Super Extreme DUI Convictions

Super Extreme DUIs have been created by certain states to punish those offenders who are stopped driving a motor vehicle with a blood alcohol concentration of 0.200 or more. Arizona is one of the states which has the “Super Extreme DUI” law in place. Although a Super Extreme DUI crime is considered a misdemeanor, the minimum jail term it carries is greater than most first time felonies.

There are five main characteristics of a Super Extreme DUI offense that make it unique. They are as follows:

Installation of an Ignition Interlock Device for an extended period of time

All DUI convictions in Arizona require the offender to install an Ignition Interlock Device in their vehicle. First time regular DUI offenders are required to install and maintain an IID in their vehicle for a minimum period of one year, but with a Super Extreme DUI conviction, the offender is required to install and maintain an IID device for a minimum period of 18 months.

Jail sentencing for an extended period

A regular DUI conviction in Arizona carries a minimum jail term of 1 day, whereas a Super Extreme DUI carries a minimum jail term of 45 days. For BAC levels between 0.150 and 0.200, the minimum jail term is 30 days.

Your name is the list of DUI offenders

If you receive a Super Extreme DUI, there will be a better chance of you getting you name out in the light. Booking photos of DUI offenders are published on the Maricopa County Attorneys’ Office website. Explicit details of the offenders may also be added with the photos, but if the offender has an exceptionally high blood alcohol test result, they are sure to have their name up there.

Out of state offenders may have to go to trial

If you are visiting Arizona from another state and get a “Super Extreme DUI,” you will face difficulty taking a plea offer. Most prosecuting offices offer long prison sentences, and in many cases, the jail sentence does not change after losing at trial.

Arizona residents facing a Super Extreme DUI may be able to maintain their employment with a granted work release program or home detention. However, these options are not available to out of state offenders. Only very few out of state jails will accommodate them if Arizona jail permits them to.
