In the State of Arizona, if a driver is found guilty of DUI with a Child in their Vehicle as a passenger, it is known as an “Aggravated DUI with Child in Car.” It is a felony that carries penalties that are more severe than a standard DUI, which is a misdemeanor.
David Cantor explains the punishments in Arizona for a DUI with a Child in the Car:
Any adult who is stopped for DUI with a Child Passenger who is under age 15 in Arizona can expect to be charged with Aggravated DUI. The individual can expect to be arrested right at the scene, and their vehicle will be impounded. In addition, Child Protective Services, or a family member, will be contacted to collect the child to bring him or her home.
The usual blood or breath test to measure the blood alcohol concentration (BAC) will be performed. Even if the person does not have a previous DUI conviction, they may face a jail time that ranges anywhere from 10 days to 45 days. On top of imprisonment, the individual can also expect to pay fines that can range anywhere from $1,667 to up to $7,000. Those with a BAC that is 0.20 or higher will be found as being guilty of Super Extreme DUI, which carries the highest consequences.
A driver who is found guilty of Aggravated DUI with a Child in their Car will also have their driver’s license revoked for a term of one year. Once the license is reinstated, the individual will also be required to have an Interlock Ignition device put onto their steering wheel. This costs $1,200 per year and it is mandatory for the driver to blow into the device before their car can start. Additionally, the driver has to blow into it every 15 minutes while driving. This is to ensure they are not driving while intoxicated.
In what should come as no surprise, a driver with an Aggravated DUI conviction is also required to have an SR-22 policy, which is a high risk auto insurance coverage. The policy is generally $500 per year and will be required for three years ($1,500) after the individual’s conviction. You can also expect your car insurance premiums to increase $3,000 per year for a total of approximately $9,000.
People who are convicted of felony Aggravated DUI can also suffer additional penalties in the form of loss of gun licenses, professional licenses and even the right to vote. Parents who are undergoing a child custody case can also expect to be deemed an unfit parent as a result of their conviction.
