Can I get a DUI on a bicycle in Arizona?

A question that we get asked a lot is: Can I get a DUI in Arizona on a bicycle?

The short answer is yes and no. In Arizona, the DUI statutes say you must be in control of a motorized vehicle. Pedaling a bike or riding on a skateboard does not qualify as a motorized vehicle. There is an exception to this rule and it is explained in the video below.

Now things get a little tricky if you are operating a motorized bicycle (Whizzer) or skateboard. If the motor is engaged, it would constitute operation of a motor vehicle.
